We will collect and process this in order to be able to fulfil our services and comply with legal requirements.

Lawful bases and data protection rights

  • Your right of access - You have the right to ask us for copies of your personal information. You can request other information such as details about where we get personal information from and who we share personal information with. There are some exemptions which means you may not receive all the information you ask for. 
  • Your right to rectification - You have the right to ask us to correct or delete personal information you think is inaccurate or incomplete. 
  • Your right to erasure - You have the right to ask us to delete your personal information. 
  • Your right to restriction of processing - You have the right to ask us to limit how we can use your personal information. 
  • Your right to object to processing - You have the right to object to the processing of your personal data. 
  • Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you. 
  • Your right to withdraw consent – When we use consent as our lawful basis you have the right to withdraw your consent at any time.

If you make a request, we must respond to you without undue delay and in any event within one month.

Our lawful bases for the collection and use of your data

Our lawful bases for collecting or using personal information are as follows:

  • Contract 

We may have to collect or use the information so we can enter into or carry out a contract. All of your data protection rights may apply except the right to object.

  • Legitimate interests 

Our service requires us to collect data about individuals relevant to any:

  • employment issue
  • workplace or other dispute
  • concern or complaint relating to work

We need to collect or use your information because it allows us to provide our service. This may in turn benefit you, your organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. 

This is our legitimate interest for processing personal data. 

  • Consent

We may seek a person’s explicit consent to process their data in certain situations.

Where do we get personal information?

We may get your personal information from the following sources:

  • From your employer or engager
  • From colleagues
  • From third parties who are authorised to share the information with us

How long do we keep information?

We only keep your personal information for so long as it is reasonably necessary. We will typically keep your personal information for a period of 7 years after the conclusion of the work for which we were engaged, under which your information was given to us.


In workplace mediations, save in exceptional circumstances, we will (immediately after the mediation) delete all confidential summaries provided by parties, and notes relating to the mediation. This is to give confidence to participants that the information they provide to the mediator is completely confidential and cannot be disclosed or obtained through matters outside of our control. 

Who do we share information with?

We may have to share your personal information with others and this any include:

  • Your employer or engager
  • Any other person involved in the issue or dispute we are contracted to investigate or assist with
  • Organisations we are legally obliged to share personal information with
  • Any person engaged to assist with the issue for which we have been engaged. This may include a sub-contractor or person assisting us
  • Our professional advisers. These third parties are subject to professional obligations of confidentiality

How can you complain?

If you have any concerns about our use of your personal data, you can make a complaint to us using the contact details at the top of this privacy notice.

If you remain unhappy with how we have used your data after raising a complaint with us, you can also complain to the ICO.
